La Follette Xarelto Lawyer

The Food and Drug Administration (FDA) approved Xarelto, a blood thinner designed to aid individuals with atrial fibrillation by reducing their likelihood of suffering from strokes and reduce knee and hip replacement recipients’ likelihood of suffering from blood clots, in 2011. Since its release, many patients were prescribed the drug, and many experienced side effects they were not made aware of when it was prescribed. This is because their doctors were not adequately educated about Xarelto’s potential side effects. Further, an FDA investigation found that Xarelto’s manufacturer, Johnson & Johnson, failed to properly test the drug and provide sufficient information about its clinical trials to the FDA.

Drug manufacturers have the responsibility to ensure that the products they market are safe for patients to use. This includes adequately warning doctors, pharmacists and patients about a drug’s potential side effects. When a victim suffers an injury, an illness, or a worsened condition because of a drug’s side effects, he or she may pursue compensation from the drug’s manufacturer through a dangerous drug claim.

Xarelto Side Effects

The FDA’s investigation found that despite Xarelto’s advertised benefits, it actually increases many patients’ risk of suffering a stroke, a heart attack, or a pulmonary embolism, some of the very conditions the drug was manufactured to prevent.

Some patients also suffered from internal bleeding, some of whom experienced potentially deadly gastrointestinal bleeding and hemorrhaging. The internal bleeding risk was especially prevalent for patients who underwent surgery while taking the drug.

Johnson & Johnson is not liable for Xarelto-related damages because the drug has side effects, but because it failed to warn to FDA and by extension, doctors, about its side effects. When a doctor and a patient do not have sufficient information about a drug, they cannot determine whether it is the best choice for the patient.

Filing a Dangerous Drug Claim

When patients – or the doctors and pharmacists who prescribe drugs to them – are not made fully aware of all of a drug’s potential side effects, the drug’s manufacturer may be liable for any damages victims suffer as a result of taking the drug.

If you suffered damages because of the side effects you experienced while taking Xarelto, you could be entitled to recover monetary compensation for them. Through a dangerous drug claim, you can pursue compensation for the following:

  • Medical expenses;
  • Lost wages due to spending time out of work; and
  • Pain and suffering damages. These include your emotional anguish related to the side effects and any additional expenses you incurred, like having to hire in-home domestic help while you recovered.
