Anyone accused of a crime deserves fair treatment throughout the legal process. At Fox & Farley, we are dedicated to providing our clients with a strong defense against their criminal charges. We represent clients from their first contact with the police through to any possible appeals. If you have been charged with a misdemeanor or felony crime, contact a Gatlinburg criminal defense lawyer to learn more about how we can help you.

Felonies and Misdemeanors

Criminal offenses are classified into felonies and misdemeanors. Felonies are more serious crimes and according to Tennessee Code 40-35-111, they are further broken into five categories. Class A felonies can receive between 15-60 years in jail along with a fine of no more than 50,000 dollars. Class E felonies are less severe with a sentencing of between one and six years in jail along with a fine of up to $3,000. Below felonies are misdemeanors, which are separated into three categories. Misdemeanor charges can be sentenced with up to a year jail and up to $2,500 fine. With the help of an experienced criminal defense lawyer, a convicted person may be able to get alternative sentences such as:

  • Fines;
  • Restitution to the victim;
  • Probation; and
  • Community service.

We can Represent You

If you have been arrested, you probably have a lot of questions. Our lawyers can explain your charges and advise you through the next steps. We have been handling criminal cases for over thirty years. Our experience extends to the following charges:

  • Homicides;
  • Robbery;
  • Carjacking;
  • Rape and sexual battery;
  • White collar crimes;
  • Theft and burglary;
  • DUI and DWI charges;
  • Drug crimes;
  • Arson;
  • Juvenile offenses;
  • Probations violations;
  • Warrant violations; and
  • Criminal appeals.

The Tennessee Code outlines what is needed to prove each type of charge and what the corresponding sentence will be. However, each crime also has previous cases that have been similar. How those cases have been resolved also set a precedent for future cases. At Fox & Farley, we closely research other cases to determine the best course of action for each our clients.

Why Hire a Gatlinburg Criminal Defense Lawyer

A criminal conviction can have long-lasting impacts in your life, even if you avoid jail. Anytime you apply for housing or a new job, you will have to disclose your criminal record. If you have been arrested and charged with a crime, you need someone to fight aggressively on your behalf. Unfortunately, public defenders are overwhelmed in their positions. Mother Jones reported that a public defender would, in reality, need a year and a half to complete the workload they are given for one year. They do not have enough time to focus on any particular case. At Fox & Farley, we are dedicated to each client we represent.
