We understand that the last thing you want to deal with during your separation is having to deal with all of the complicated and tedious legal matters that divorces entail, which is why the Pigeon Forge divorce and family lawyers of Fox, Farley, Willis & Burnette strive to make this process as smooth and seamless as possible. The outcome of your divorce or family matters will very likely shape your life in the years to come, and coming to a desirable resolution is only possible with an experienced Pigeon Forge family & divorce lawyer at your side. We provide assistance to clients in matters such as divorce and division of assets, alimony, child custody and visitation, divorce, and child support.

Division of Assets

There are two types of personal property that you have as a married person: marital property and non-marital property. Marital property is everything acquired during the length of the marriage, including real property, bank accounts, furniture, and more. Non marital property is virtually everything else, including inheritance and personal injury lawsuit winnings.  Marital property is divided in accordance with Tennessee code 36-4-121: all marital property will be divided as the court deems just, without regard to marital fault. This means that all marital property will be divided fairly, though not necessarily equally. Our lawyers aggressively fight for your property during divorce cases.

Child Custody and Visitation Rights

Whether you are going through divorce or have never been married, the court will always choose in favor of the child’s best interests in regards to custody and visitation arrangements. In the past, mothers were nearly always awarded full legal custody, though that has been put to an end in more recent years. Fathers can be just as likely to gain full or shared custody of their children as mothers, so long as the court believes that the child will benefit from that arrangement.

Child Support

Married mothers or fathers, as well as single parents who were never married, are entitled to child support from the noncustodial parent. We advocate on behalf of either the paying or receiving parent.

Alimony

Alimony, which is also called spousal maintenance comes in four different forms, according to the Tennessee Bar Association. It is usually only awarded for a short time period, either through the duration of the divorce or in the months afterwards. However, support may be awarded until death of either party in some cases. Factors such as the length of the marriage, ability of the lower earning spouse to become self-sufficient, and what each party brought to the marriage are all taken into account when spousal support is determined by the court.
